1. Acceptance of Terms

By accessing or using ChekiRent, you agree to comply with these Terms and all applicable laws and regulations.

If you are using ChekiRent on behalf of a business, property owner, organization, or other entity, you confirm that you have the authority to accept these Terms on its behalf.

2. Eligibility and Accounts

You must provide accurate and complete information when creating an account or using ChekiRent.

You are responsible for:

• Maintaining the confidentiality of your account credentials;
• Keeping your account information accurate and up to date;
• All activities carried out through your account; and
• Immediately notifying ChekiRent if you believe your account has been accessed or used without authorization.

You must not create an account using false information, impersonate another person or entity, or create an account for fraudulent or unlawful purposes.

3. User Responsibilities

Users are responsible for their conduct and activities on the ChekiRent platform.

Users agree not to:

• Provide false, misleading, or fraudulent information;
• Upload or publish information that they do not have the right to use;
• Impersonate another person, landlord, tenant, property manager, or organization;
• Use ChekiRent for unlawful, fraudulent, or abusive activities;
• Attempt to gain unauthorized access to ChekiRent accounts, systems, or data;
• Interfere with or disrupt the operation or security of the platform;
• Introduce malicious software, code, or other harmful material; or
• Use the platform in a manner that violates these Terms or applicable law.

4. Property Listings and Information

Landlords, property managers, and other users who publish property information are responsible for ensuring that the information they provide is accurate, current, and not misleading.

ChekiRent does not guarantee the accuracy, ownership, availability, condition, legality, suitability, or quality of any property, listing, service, or information submitted by users.

ChekiRent may review, restrict, suspend, or remove listings or other content that we reasonably believe violates these Terms, applicable law, or our platform policies.

Users are responsible for conducting their own verification and due diligence before entering into any tenancy, rental, property, payment, or other agreement with another user.

5. Payments and Fees

Certain ChekiRent features or services may require payment of applicable fees or subscriptions.

Where applicable, users are responsible for reviewing the fees associated with the services they use and ensuring that payment information provided to ChekiRent or its payment providers is accurate.

Payments may be processed through third-party payment providers. Where a third-party provider processes a payment, that provider's terms and policies may also apply.

ChekiRent is not responsible for failures, delays, reversals, unauthorized transactions, or other issues caused by a payment provider, financial institution, telecommunications provider, or other third party, except where liability cannot legally be excluded.

Unless expressly stated otherwise, ChekiRent does not become a party to the underlying rental, tenancy, property, or other agreement between users merely because the platform facilitates payment-related information or services.

6. User Content

Users may submit information, photographs, property details, documents, messages, or other content through ChekiRent ("User Content").

Users retain ownership of the User Content they have the legal right to own.

By submitting User Content to ChekiRent, you grant ChekiRent a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and use that content to the extent reasonably necessary to operate, maintain, secure, and improve the ChekiRent services.

You are responsible for ensuring that your User Content does not violate the rights of another person or entity or applicable law.

7. Intellectual Property

The ChekiRent platform, including its software, design, branding, logos, trademarks, interfaces, text, graphics, and other platform materials, is owned by or licensed to ChekiRent and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms or by ChekiRent in writing, users may not copy, reproduce, modify, distribute, sell, reverse engineer, or otherwise exploit ChekiRent's intellectual property.

Nothing in these Terms grants you ownership of ChekiRent's intellectual property.

8. Third-Party Services

ChekiRent may integrate with or rely upon third-party services, including payment processors, communication providers, hosting providers, mapping services, authentication providers, analytics services, and other technology providers.

The availability and operation of third-party services may be outside ChekiRent's control.

Your use of third-party services may be subject to the terms, conditions, and privacy policies of those third parties.

9. Disputes Between Users

ChekiRent provides a platform and related tools that may assist users in managing property-related activities and interactions.

Unless expressly stated otherwise, ChekiRent is not a party to agreements between landlords, tenants, property managers, service providers, or other users.

Disputes concerning tenancy agreements, rent, deposits, property ownership, property condition, maintenance, eviction, services, payments, or other dealings between users should primarily be resolved by the parties involved.

ChekiRent may, where appropriate, investigate reported violations of these Terms and take action against accounts or content that violate our policies.

Nothing in this section prevents a user from exercising any rights or remedies available under applicable law.

10. Suspension and Termination

ChekiRent may suspend, restrict, or terminate access to an account or the platform where we reasonably believe that:

• These Terms have been violated;
• The account has been involved in fraud or unlawful activity;
• The account presents a security or operational risk;
• Information provided by the user is materially false or misleading;
• Applicable fees remain unpaid; or
• Suspension or termination is necessary to protect ChekiRent, its users, or third parties.

Where reasonably practicable, ChekiRent may provide notice before taking such action. However, immediate action may be taken where necessary to protect the platform, users, or third parties.

Users may stop using ChekiRent at any time, subject to any outstanding obligations.

Certain provisions of these Terms, including those relating to intellectual property, liability, disputes, and obligations that by their nature should survive termination, will continue to apply after termination.

11. Service Availability

ChekiRent aims to provide reliable and secure services but does not guarantee that the platform will always be available, uninterrupted, error-free, or free from security vulnerabilities.

The platform may occasionally be unavailable because of maintenance, upgrades, technical failures, security incidents, network problems, third-party service interruptions, or circumstances beyond our reasonable control.

ChekiRent may modify, suspend, discontinue, or replace features or services where reasonably necessary to operate or improve the platform.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ChekiRent shall not be liable for any direct, indirect, incidental, consequential, special, or other losses, damages, costs, or claims arising from or related to the use of, or inability to use, the ChekiRent platform.

ChekiRent does not guarantee or assume responsibility for the actions, omissions, representations, or conduct of landlords, property managers, tenants, service providers, payment providers, or other third parties using or interacting with the platform.

Without limitation, ChekiRent shall not be responsible for losses or disputes relating to property ownership, tenancy agreements, rental payments, deposits, arrears, property condition, eviction, maintenance, service delivery, or other arrangements between users.

ChekiRent may facilitate certain communications, records, listings, payment-related information, or other services between users, but such facilitation does not make ChekiRent a party to any agreement or transaction between users unless expressly stated otherwise.

Users remain solely responsible for verifying information, entering into agreements, making or receiving payments, and resolving disputes arising from their dealings with other users or third parties.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless ChekiRent, its owners, employees, contractors, service providers, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from:

• Your violation of these Terms;
• Your unlawful or fraudulent use of the platform;
• Your User Content;
• Your violation of another person's rights; or
• Your dealings or disputes with other users or third parties.

This obligation applies only to the extent permitted by applicable law.

14. Privacy

Your use of ChekiRent is also governed by our Privacy Policy, which explains how we collect, use, store, protect, and otherwise process personal information.

By using ChekiRent, you acknowledge that you have reviewed our Privacy Policy.

15. Changes to These Terms

ChekiRent may update or modify these Terms from time to time.

When material changes are made, we may provide reasonable notice through the platform, email, or other appropriate communication methods.

The updated Terms will become effective on the date specified in the updated Terms.

Your continued use of ChekiRent after the effective date of updated Terms constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya, except where applicable law requires otherwise.

Any dispute concerning these Terms shall be subject to the jurisdiction of the courts or other legally recognized dispute-resolution mechanisms applicable in Kenya.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permitted.

The remaining provisions of these Terms shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the ChekiRent Privacy Policy and any additional terms expressly applicable to specific ChekiRent services, constitute the agreement between you and ChekiRent concerning your use of the platform.

They supersede previous agreements or understandings concerning the same subject matter, except where otherwise expressly stated.
